Privacy Policy; Terms of Use

1. Purpose.  Gem Castle Yukizaki Hawaii Co., Ltd., a Hawaii corporation (the “Company”), will handle and protect Personal Information collected from its customers in the manner set forth in this policy.　
   
   
2. Applicability.  This Policy applies to all customers and users of the Company’s services, who provide
   personal information to the Company, and to all personal information collected, maintained, transmitted, stored, retained, or otherwise used by the Company regardless of the media on which the information is stored and whether relating to employees, customers, or any other person.
   
   
3. Definitions.
   "Personal Information" means information the Company has collected or otherwise maintains or has in its possession that identifies or can be used to identify or authenticate an individual, including, but not limited to names, addresses, telephone numbers, email addresses, date of birth, age, gender, credit history, image (photograph of the person), signature of the person, government-issued identification numbers, images of state- or government issued driver’s license, passport, or other identification cards, social media account and contact information, including but not limited to Facebook, Instagram, Line, and Whatsapp, user passwords or PINs, user identification and account access credentials, passwords, PINs and security question answers, credit card and financial account numbers, product purchase and service usage history, personal characteristics or profiles connected to a unique individual, including interests, habits, or activities, and marketing preferences.
   "Sensitive Personal Information" means Personal Information that if lost, compromised, accessed, or improperly disclosed could result in harm, embarrassment, inconvenience, or unfairness to an individual and that therefore is subject to heightened protections. Examples of Sensitive Personal Information include, but are not limited to:
   •• An individual's government-issued identification number, including a social security number, driver's license number, or state-issued identification number.
   •• A financial account number, credit card number, or debit card number with or without any required security code, access code, personal identification number, or password, that would permit access to an individual's financial account.
   
   
4. Collection of Personal and Sensitive Personal Information.    The Company will collect and store Personal Information and Sensitive Personal Information from customers written or entered into application forms or customer information cards when inquiring about or requesting services or products or provided in communications such as telephone calls or emails, with the customer’s consent.
   
   
5. Purposes of Use.   The Company will use this Personal Information and Sensitive Personal Information for the following purposes:
   •• To provide services requested by customers or inform customers about the status of services.
   •• To perform the Company’s obligations and enforce its rights under contracts with customers, including billing and collection.
   •• To request feedback from customers regarding products or services.
   •• To conduct market analysis to help develop better products and services.
   •• To provide advertisements about new products and services according to customer tastes, product purchase history, and preferences.
   •• To collect, keep, and report information required by applicable law.
   •• To prevent and take countermeasures against fraudulent and criminal activity and assist law enforcement in enforcement activities under applicable law.
   •• To monitor, analyze, and take countermeasures as necessary to identify unauthorized use of electronic payment methods.
   
   6. Handling and Retaining Personal Information.
   •• The Company will protect Personal Information and Sensitive Personal Information in a manner consistent with applicable law.
   •• The Company may provide Personal Information and Sensitive Personal Information to its Japan affiliate, Kabushiki Gaisha Gem Castle Yukizaki.
   •• The Company may provide to government and law enforcement agencies, required information regarding customers and sellers who sell secondhand or previously owned articles to the Company and applicable transactions.

   7. Disclosure and Correction of Personal Information.   When a customer requests the disclosure, deletion, erasure, correction, suspension of consent to use, or suspension of consent to provision to third parties of their Personal Information, the Company’s Customer Service Department will promptly respond to these requests. However, the Company may ask for state issued identification when responding to such requests for security purposes. In situations where customer Personal Information has already been deleted, destroyed, or its use is suspended, the Company may not be able to provide the requested information. Customer Personal Information will be stored by the Company indefinitely, subject to periodic deletion or destruction for purposes of organizing stored information. The Company will comply with applicable laws when destroying Personal Information.
   
   8. Destruction of Personal Information.   In accordance with law, the Company will take reasonable measures to protect against unauthorized access to or use of the information in connection with or after its disposal, including implementing and monitoring compliance with policies and procedures that prohibit the removal of Personal Information from the Company premises, and require the destruction of personal information, electronic media, and other non-paper media in a manner that the information cannot be practicably read or reconstructed, such as by placement in a designated disposal bin and proper disposal of personal records, such as by shredding.
